What is Sexual Abuse?

Different states define sexual abuse in different ways. In Nebraska, the law defines sexual assault as sexual contact or penetration without the consent of the victim. It could mean that the victim was threatened or forced into sexual contact, pulled away from the offender or pushed the offender away, was deceived into giving consent, or simply said “no.”

Even though this area of the law would seem to be straightforward, it is actually very complex. If you are considering filing a sexual abuse lawsuit, your attorney to be extremely familiar with Nebraska law.

At Baron & Budd, our attorneys have the experience and knowledge needed to answer these questions and provide expert representation to our clients.

Examples of Sexual Abuse in Nebraska

Nebraska is a wonderful state, but it is, unfortunately, not immune to childhood sexual abuse and other crimes. These are just a few examples of alleged sexual abuse committed by Nebraskans in positions of trust.

  • A Catholic priest in the central Nebraska town of Ord was charged with first-degree sexual assault in January 2019 after allegedly attacking a woman in her early 30s. The alleged assault occurred in the priest’s home, a church rectory.
  • In December 2018, the Catholic Archdiocese of Omaha released the names of nearly 40 priests accused of sexual abuse. The accusations stretch back as far as 50 years.
  • An Omaha elementary school teacher was accused of sexually abusing five students. Other teachers reported they saw the man abusing a student on the school’s playground.
